General Terms and Conditions

1. Scope

The following terms and conditions apply to all orders placed through our online shop by consumers and entrepreneurs.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed. An entrepreneur is a natural or legal person or a legal partnership who, when entering into a legal transaction, acts in the exercise of their commercial or self-employed professional activity.

For entrepreneurs: If the entrepreneur uses conflicting or supplementary general terms and conditions, their applicability is hereby contradicted; they will only become part of the contract if we have expressly agreed to them.

2. Contractual Partner, Conclusion of Contract, Correction Options

The purchase contract is concluded with FlowersDeluxe Sole Proprietorship.

By listing the products in the online shop, we make a binding offer to conclude a contract for these products. You can initially place our products in the shopping cart without obligation and correct your entries before sending your binding order at any time by using the correction aids provided and explained during the ordering process. The contract is concluded by clicking the order button, thereby accepting the offer for the products in the shopping cart. Immediately after submitting the order, you will receive a confirmation by email.

3. Contract Language, Contract Text Storage

The available languages for the contract conclusion are: German, English.

We store the contract text and send you the order data and our terms and conditions in text form. You can view the contract text in our customer login.

4. Subject of the Contract

The applicability of the respective product description as an essential part of the contract is indicated.

Due to individual screen configurations (e.g., resolution and brightness), slight deviations between the displayed and actual product colors are possible.

5. Delivery Conditions

Delivery Options

We ship the products to the delivery address specified in the order process.

We only deliver by shipping. Self-collection of the goods is unfortunately not possible.

We do not deliver to parcel stations.

6. Payment

6.1 Prices

The prices stated at the time of the order apply. These are total prices and include the statutory VAT.

6.2 Due Date and Default of Payment

The price is due upon conclusion of the contract unless a later date results from the following payment conditions.

For consumers: In the event of default of payment, we reserve the right to charge you a fee of 1.50 euros for the second and each subsequent reminder. You are entitled to prove that a lower damage has occurred. Further claims remain unaffected.

For entrepreneurs: In the event of default of payment, we reserve the right to charge you the statutory default interest of nine percentage points above the base interest rate as well as a flat rate of 40 euros. Further claims remain unaffected.

6.3 Payment Methods

In our shop, the following payment methods are generally available:

Prepayment
If you select the payment method prepayment, we will provide you with our bank details in a separate email and deliver the goods after receipt of payment.

Credit Card
During the ordering process, you provide your credit card details. Your card will be charged immediately after placing the order.

SEPA Direct Debit
By placing the order, you authorize us to collect the amount from your account. We will inform you of the date of the debit at least one banking day in advance (so-called prenotification). A banking day is any weekday except Saturdays, nationwide public holidays, and December 24 and 31 of each year. The debit will occur before the goods are shipped.

Apple Pay
To pay the invoice amount through the payment service provider Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA ("Apple"), you must use the "Safari" browser, be registered with Apple, have Apple Pay enabled, authenticate with your login data, and confirm the payment instruction. The payment transaction will be carried out immediately after placing the order. Further information is provided during the ordering process.

Klarna
In cooperation with the payment service provider Klarna Bank AB (publ.), Sveavägen 46, 111 34 Stockholm, Sweden ("Klarna"), we offer you the following payment options. Payment via Klarna is only available for consumers. Unless otherwise stated, payment via Klarna requires a successful address and credit check and is made directly to Klarna. Further information is provided with each payment option and during the ordering process.

Purchase on Invoice via Klarna
The invoice amount is due 30 days after shipping of the goods and receipt of the invoice.

Klarna may offer additional payment modalities to registered and selected Klarna customers. We have no influence on the offering of these modalities; further individually offered payment modalities affect your legal relationship with Klarna. Further information can be found in your Klarna account.

Klarna Direct Debit
You authorize Klarna to collect the amount by direct debit. Klarna will inform you of the date of the debit (so-called prenotification). The debit will occur after shipping of the goods.

PayPal, PayPal Express
To pay the invoice amount through the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, authenticate with your login data, and confirm the payment instruction. The payment transaction will be carried out immediately after placing the order. Further information is provided during the ordering process.

PayPal may offer additional payment modalities to registered and selected PayPal customers. We have no influence on the offering of these modalities; further individually offered payment modalities affect your legal relationship with PayPal. Further information can be found in your PayPal account.

Credit Card via PayPal
Your card will be charged by PayPal after shipping of the goods.

Direct Debit via PayPal
Payment by direct debit via PayPal requires an address and credit check and is made directly to PayPal. By confirming the payment instruction, you authorize PayPal to collect the amount by direct debit. PayPal will inform you of the date of the debit (so-called prenotification). The debit will occur before shipping of the goods.

Sofort by Klarna
To pay the invoice amount through the payment service provider Sofort GmbH, Theresienhöhe 12, 80339 Munich, you must have an online banking enabled bank account, authenticate accordingly, and confirm the payment instruction. Your account will be charged immediately after placing the order. Further information is provided during the ordering process.

7. Right of Withdrawal

You have the statutory right of withdrawal as described in the withdrawal instructions.

8. Retention of Title

The product remains our property until full payment has been made.
For entrepreneurs, the following also applies: We retain ownership of the product until all claims arising from an ongoing business relationship have been settled. You may continue to sell the reserved goods in the ordinary course of business; any claims arising from this resale, regardless of whether the reserved goods have been combined or mixed with a new item, are assigned to us in advance up to the amount of the invoice value, and we accept this assignment. You remain authorized to collect the claims, but we may also collect them ourselves if you do not meet your payment obligations. We will release the securities to the extent that the realizable value of the securities exceeds the value of the open claims by more than 10%.

9. Warranty and Liability

The warranty rights apply. In the case of consumers, warranty claims expire two years from the delivery of the goods. For entrepreneurs, the warranty period is one year from the delivery of the goods.

Our liability is limited to intent and gross negligence. For slight negligence, we are only liable for breaches of essential contractual obligations. In such cases, liability is limited to foreseeable damage. These limitations of liability do not apply in case of injury to life, body, or health, or in accordance with the Product Liability Act.

10. Dispute Resolution

The European Commission provides a platform for online dispute resolution (OS) which you can find at http://ec.europa.eu/consumers/odr. We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board and generally do not do so.

11. Final Provisions

If individual provisions of the contract are or become invalid, this does not affect the validity of the remaining provisions. The statutory provisions apply to the gaps.

The place of jurisdiction for all disputes arising from the contractual relationship is our place of business if you are an entrepreneur.

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
